These Terms of Service (these “Terms”) are concluded between you (hereinafter referred to as “You”, “User”, or “Your”) and MoBit (hereinafter referred to as “MoBit”, “the Website”, “We”, “Us”, or “Our”). By accessing, loading, or using any services provided by MoBit (the “Services”), You acknowledge that You have read, understood, and agree to be bound by these Terms as well as our Privacy Policy.   • “MoBit”, “Website”, “Services”, “We”, “Us”, “Our” refer to the website and related products and services of MoBit, including any mobile applications, as well as the company owning and operating the Website.
  • “User”, “You”, “Your” refer to you, whether a natural or legal person, who accesses the Website, uses the Services, and accepts these Terms.
  • “Party” refers to either the User or MoBit; collectively, the “Parties”.
  • “Crypto Assets” means assets that are transferred exclusively using blockchain or similar distributed ledger technology, including digital coins, tokens, and other digital media of exchange or value.
  • “Cryptocurrency” refers to entries recorded on a blockchain network.
  • “Exchange” refers to exchanging one Crypto Asset for another Crypto Asset, whether on the same or a different blockchain network.

1.3 Unless otherwise stated, words in the singular include the plural and vice versa; words denoting any gender include all genders.

1.4 MoBit may update these Terms at any time at its sole discretion. If You have not read or do not accept the current version of these Terms, You must not use or continue to use the Services.

2. Personal Information

2.1 By accepting these Terms, You expressly authorize MoBit to process Your personal information and, where applicable, to transfer and store Your personal information outside of Your jurisdiction, in accordance with Our Privacy Policy.

3. Suspension and Termination

3.1 MoBit reserves the right, at its sole and absolute discretion, to terminate Your access to the Website and/or Services for any reason, including for any breach of these Terms, immediately, without prior notice, and without liability.

3.2 MoBit may suspend or block Your access to the Website and/or Services for any reason, including suspected or actual breach of these Terms, immediately, without prior notice, and without liability.

3.3 MoBit is under no obligation to provide reasons for any suspension or termination actions.

4. Exchange/Refund Policy

4.1 You acknowledge and accept that using the Services involves risks, including currency and market risks. All Exchanges are final, and amounts are generally non-refundable once processed.

4.2 Any MoBit decision regarding a refund or Exchange is final.

4.3 Valid refunds must be initiated within 15 days of the original transaction.

4.4 In the event of dramatic market movements, MoBit may suspend fixed-rate Exchanges. In such cases, MoBit may complete the Exchange at the market rate or return the Crypto Asset to the User, at the User's choice. For these Terms, “dramatic market changes” means a price movement of 4% or more in either direction.

4.5 MoBit is not responsible for funds transferred to phishing or fraudulent websites. Always verify the correct URL and security indicators in Your browser. Never trust private messages or withdrawal requests purportedly from MoBit personnel without independent verification through official channels.

4.6 In limited circumstances, MoBit may hold User funds for up to 12 months. After that period, MoBit cannot warrant the security of unclaimed funds. Upon User request, MoBit will use reasonable efforts to return unclaimed funds, but MoBit is not liable for the outcome.

4.7 “Fake” or fraudulent tokens are tokens without legitimate value that mimic existing projects but lack the official contract address. If a deposit involves non-official or fake token contracts, MoBit may not recognize the deposit, and such tokens will not be exchanged or returned.

5. Prohibited Jurisdictions

5.1 By accessing or using the Services, You represent and warrant that You are not located in, a citizen or resident of: (a) the United States of America; (b) any country or territory subject to United Nations or equivalent sanctions; or (c) any jurisdiction where the use of Cryptocurrency is prohibited by applicable law.

5.2 MoBit reserves the right to determine its operating markets and jurisdictions and may limit or refuse Services in certain countries.

5.3 MoBit may use various methods to prevent access by Users in prohibited jurisdictions. You must comply with this section even if such methods are circumvented or ineffective.

5.4 Use of the Website is void where prohibited by law.

5.5 MoBit may collect Your IP address. If Your IP address indicates a prohibited jurisdiction, MoBit may deny access to the Website and Services.

6. Exclusion of Liability

6.1 Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

6.2 You expressly understand and agree that You use the Website and Services at Your own risk. The Website and Services are provided on an “as is” and “as available” basis without warranties of any kind.

6.3 To the maximum extent permitted by law, MoBit disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

6.4 Without limiting the foregoing, MoBit does not warrant that: (a) the Services will meet Your expectations; (b) the Services will be uninterrupted, timely, secure, or error-free; (c) any data provided is accurate or reliable; or (d) the Website or content is free of viruses or other harmful components.

7. Acceptable Use

7.1 Using the Website may involve financial risks and should be treated as an experimental utility.

7.2 By accessing or using the Website, You agree not to violate any laws, contracts, intellectual property rights, or third-party rights, and You are solely responsible for Your conduct.

7.3 Without limiting the foregoing, You agree not to:

  • Interfere with, damage, or degrade the performance or security of the Website;
  • Use the Services to fund, support, or engage in any illegal activities (including illegal gambling, fraud, money laundering, or terrorist activity);

8. Exchange Rates and Fees
